Der Gerichtshof hat nämlich gestützt auf die Regel Nr. 1 Ziff. 1 und 2 der Verordnung Nr. 1685/2000 festgestellt, dass der Grundsatz der Kostenerstattung nur für die von der Kommission in Form von Zwischen‐ oder Restzahlungen getätigten Zahlungen im Sinne von Art. 32 Abs. 1 Unterabs. 3 der Verordnung Nr. 1260/1999 gilt (Urteil vom 24. November 2005, oben in Randnr. 36 angeführt, Randnrn. 48 und 49).

59. The concept of ‘placing in agistment’ for the purposes of the second subparagraph of Article 1(3) of Regulation No 2700/93 on detailed rules for the application of the premium in favour of sheepmeat and goatmeat producers, the purpose of which is to ensure that the animals moved have been identified before they are kept together with other animals, must be interpreted as applying to cases in which animals are kept together with others on the basis of the farming in common of flocks and herds belonging to different owners.

Der Begriff der Pensionshaltung im Sinne von Artikel 1 Absatz 3 Unterabsatz 2 der Verordnung Nr. 2700/93 mit Durchführungsbestimmungen zur Gewährung der Prämie an die Erzeuger von Schaf- und Ziegenfleisch, der für die Kennzeichnung der in anderen Betrieben gehaltenen Tiere sorgen soll, damit sie nicht mit anderen Tieren vermischt werden, ist dahin auszulegen, dass er auch auf die Fälle Anwendung findet, in denen die Tiere aufgrund der gemeinsamen Aufzucht von Herden verschiedener Eigentümer mit anderen Tieren vermischt werden.

60. If, however, when a textile product is offered for sale or is sold to the consumer as referred to in the first subparagraph, a trade mark or a name of an undertaking is indicated which contains, on its own or as an adjective or as a root, one of the names listed in Annex I or a name liable to be confused therewith, the trade mark or the name of an undertaking must be immediately preceded or followed by the names, descriptions and particulars as to textile fibre content referred to in Articles 3 to 6 and in Annex I, in clear and legible print.

Wird jedoch beim Angebot zum Verkauf oder beim Verkauf an den Endverbraucher im Sinne von Unterabsatz 1 ein Markenzeichen oder eine Firmenbezeichnung angegeben, wobei eine der in Anhang I aufgeführten Bezeichnungen oder eine damit verwechselbare Bezeichnung alleinstehend, als Eigenschaftswort oder in Wortverbindungen verwendet wird, so müssen die in den Artikeln 3 bis 6 sowie in Anhang I vorgesehenen Bezeichnungen, Zusätze und sonstigen Angaben über die Zusammensetzung der Textilfasern in leicht lesbaren und deutlich sichtbaren Buchstaben unmittelbar bei dem Markenzeichen oder der Firmenbezeichnung angegeben werden.

61. 37 With regard to the origins of Article 11(3)(e) of Regulation No 883/2004, which are set against a background of modernisation and simplification of the rules contained in Regulation No 1408/71, it should be pointed out, as the Advocate General also stated in point 49 of his Opinion, that that provision replaced Article 13(2)(f) of Regulation No 1408/71, which provided that ‘a person to whom the legislation of a Member State ceases to be applicable, without the legislation of another Member State becoming applicable to him in accordance with one of the rules laid down in the aforegoing subparagraphs or in accordance with one of the exceptions or special provisions laid down in Articles 14 to 17, shall be subject to the legislation of the Member State in whose territory he resides’.

13 Abs. 2 Buchst. f der Verordnung Nr. 1408/71 ersetzt wurde, der vorsah, dass „eine Person, die den Rechtsvorschriften eines Mitgliedstaats nicht weiterhin unterliegt, ohne dass die Rechtsvorschriften eines anderen Mitgliedstaats gemäß einer der Vorschriften in den vorhergehenden Buchstaben oder einer der Ausnahmen bzw. Sonderregelungen der Artikel 14 bis 17 auf sie anwendbar würden, ... den Rechtsvorschriften des Mitgliedstaats [unterliegt], in dessen Gebiet sie wohnt“.
